Terms of Service

These terms govern your use of Oak City Intelligence, a trade name of Mony Group LLC, a North Carolina limited liability company ("we," "us," or "our"). By using this site, booking a session, becoming a member, or communicating with us by phone, SMS, or email, you agree to these terms.

What We Offer

Oak City Intelligence provides AI advisory, custom software builds, and conversational AI products (including AI receptionist and agent services) for small businesses. Specific deliverables, timelines, and pricing for engagements beyond standard productized offerings are confirmed in a separate written scope or proposal.

Eligibility

You must be at least 18 years old and legally able to enter contracts in your jurisdiction to use our services. By engaging us on behalf of a business, you represent that you are authorized to do so.

Accounts

Some of our products require an account. You agree to provide accurate information, keep your credentials confidential, and let us know promptly of any unauthorized use. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a security or compliance risk to other users.

Acceptable Use

You agree not to:

• Use our services to send unsolicited bulk messages, spam, or content that violates carrier or platform policies (including A2P 10DLC and TCPA in the United States).
• Impersonate any person or entity, or misrepresent your affiliation with one.
• Reverse engineer, scrape, or attempt to circumvent rate limits or access controls.
• Use our services for unlawful activity, harassment, or content that infringes others' rights.
• Use our AI products to make consequential decisions (medical, legal, financial, employment, housing) without appropriate human review.

SMS and Voice Communications

If you provide your phone number — by calling, texting, or filling out a form — you consent to receive SMS and voice communications from us related to the inquiry or service you initiated. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for assistance. Our full SMS practices are described in our Privacy Policy.

Calls to and from numbers operated by Oak City Intelligence may be recorded and transcribed for quality, training, and product-improvement purposes. By continuing the call after the greeting, you consent to recording.

Fees and Payment

Fees for sessions, memberships, and products are stated at the point of purchase. Recurring subscriptions renew automatically until canceled. You can cancel at any time; cancellation takes effect at the end of the current billing period and we do not pro-rate refunds for partial periods. Failed payments may result in service suspension; we'll notify you and give you a reasonable opportunity to update your payment method before any cancellation.

Intellectual Property

We retain ownership of our website, software, designs, methodologies, and any proprietary tools we use to deliver services. For custom engagements, ownership of deliverables created specifically for you is addressed in your scope or proposal — by default, you receive a perpetual license to use the deliverables for your business while we retain rights to the underlying methods and components.

You retain ownership of your own data and content. By using our services, you grant us a limited license to process your content as needed to deliver the service.

Third-Party Services

Our products integrate with third-party services (e.g., Twilio for phone and SMS, Stripe for payments, Calendly for booking, hosted AI models). Their use is governed by their own terms and privacy policies, and we are not responsible for their availability or actions.

AI Output Disclaimer

Our products use large language models and other AI systems whose outputs can be incorrect, biased, or inconsistent. AI-generated responses are not professional advice (medical, legal, financial, or otherwise). You are responsible for reviewing AI output before acting on it in any consequential context.

Warranty Disclaimer

Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, Mony Group LLC, its members, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of our services. Our total liability for any claim related to the services is limited to the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to defend and indemnify us against claims arising from your misuse of the services, your violation of these terms, or your violation of any law or third-party right.

Governing Law and Disputes

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Wake County, North Carolina, and you and we consent to the exclusive jurisdiction of those courts.

Changes

We may update these terms from time to time. We'll update the effective date above and, for material changes, notify active customers by email or in-product. Continued use after an update means you accept the revised terms.
